These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions, you may not use or access this Website.
Our terms and conditions apply to all purchases from Respire Living and should be read carefully.
Registration / Information
You warrant that:
The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects.
If you have shopped with us we will hold your name, address, telephone number and email address. Credit card details are held by Barclaycard who is our payment provider so we do not see or have access to them.
We will also hold the delivery address(es) for your orders and the password information associated with your account. We also maintain a record of your product selections.
We also use the information to keep you up to date with Respire Living through our emails as appropriate.
You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.
We reserve the right to:
- modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
- change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.
When you use our website, you’ll see that we offer you recommendations, showing products we think you might like and could perhaps miss when you’re browsing the site.
These are based past purchases, top sellers, ratings and recently-viewed products. We determine your interests and suggest new products you may like; additionally we compare the interests and buying habits with all our customers, to show you relevant products.
Recommendations may change when you make as customers purchasing habits change over time.
We take reasonable care to ensure our recommendations are in line with overall customer purchases. Details of the products we recommend – such as price – are correct at the time recommendations are made, but can be subject to change without notice.
Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.
Product Pricing, Descriptions, Images & Estimated Time of Arrivals
All prices published are in pounds sterling and are inclusive of VAT at the prevailing rate. Each product purchased is sold subject to its Product Description.
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. However, as our products are not mass-produced, and many are either hand-made from natural materials or hand-finished, slight variations in colour and/ or size may occur.
We aim to keep the Website as up to date as possible, the information, including Product Descriptions, appearing on this Website at a particular time may not always reflect the situation at the exact moment you place an order. The images shown online are for illustration purposes only. Many products are also shown with additional props but these are not included in the sale of a product unless otherwise specified.
Estimated delivery dates are for guidance only and may change due to unexpected delivery problems. Estimated delivery dates reflect when deliveries are expected to arrive at our warehouse, please allow a further 7 days for stock to be quality control checked and booked in. Items arriving from overseas may be subject to severe delays.
Sale Item Disclaimer
Sale prices are valid from the time that it displays online and cannot be retrospectively applied to an order. If an item was purchased at full price, it will need to be returned in the appropriate way and then reordered.
We have limited stocks of our sale items, due to the fact our stock levels are updated periodically, a product may sell out and not be available.
Consumer Contracts Regulations 2013
This legislation offers you the following cancellation rights when you buy online or by phone:
- You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.
- Your right to return or cancel products does not apply to goods that are made to measure or are made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly. This doesn’t affect your statutory rights if goods are faulty or not as described.
- If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.
- To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address.

- If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This excludes the cost of delivery
- We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
When you place an order, we will require your name, e-mail address and payment details. Without this information we will not be able to process your request or notify you of acceptance of your order.
An email confirmation is only a confirmation that we have received your order and/or payment. It is not an acceptance of your order and we retain the right to contact you and issue a full refund in the event of complications with your order; including, but not limited to, incorrect pricing, stock availability and delivery charges.
A contact telephone number is also required so that we may reach you if there is a problem with your order, or if your order requires a delivery quote. We may, unless you advise us otherwise, pass this information to our couriers or other agents in case they need to contact you to arrange the processing or delivery of your order.
Once your order has been despatched, the completion of the contract between Respire Living and yourself takes place. We cannot fulfil any obligations due to the following reasons:
- The product you ordered being unavailable from stock
- Our inability to obtain authorisation for your payment
- The identification of a pricing or product description error
- Customers who fail to reach any order criteria set out in the Terms & Conditions
If there are any problems with your order, you will be contacted by one of our Customer Services Representatives either by email or by phone.
We reserve the right to reject any offer of purchase by you at any time.
We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure but, in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.
Payment for all orders is at point of sale and not at point of despatch.
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery.
You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer.
If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion.
We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; to be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:
- Register by providing your name, phone number, e-mail address, payment details and other requested information
- Be over 18 years of age
- Stipulate a delivery address in the United Kingdom. Please note that PO Box numbers, hotels and accommodation addresses are not acceptable. Deliveries outside mainline UK, please contact the showroom at firstname.lastname@example.org for further details.
- Possess a valid credit or debit card issued by a bank acceptable to us
By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
We do not accept international payment over the phone or via our website. You can however make a bank transfer – please call our customer service team on +44 (0) 1424-433000 for more information
Many of our larger items including furniture and mirrors are not carried as a stock item and are ordered direct from the manufacturer, we do aim to keep as much of our range in stock, however, during busy times of the year, stock may sell out quickly or be limited in availability.
Where a product is not in stock, we try our very best to display an estimated re-stocking date on a product page if the information is available.
Our made to order products have their own delivery leads times and you are encouraged to look at these prior to placing an order. We will confirm made to order estimated delivery dates at the point of placing an order
We can deliver anywhere in England & Wales; there is a premium for deliveries to Scotland and Northern Ireland. Please note that PO Box numbers, hotels and accommodation addresses are not acceptable.
We deliver Overseas Deliveries subject to availability of service, accessibility to property, local customs costs/regulations, transport mode and shipment size. Unfortunately we are unable to deliver Respire Living orders to a number of countries, please contact the showroom for details
For orders outside of Mainland UK, a quote will be required for delivery. You can continue to place your order as normal we will provide a quote by email for approval and payment before we process your order, please contact our Showroom on + 44 (0) 1424-433000 for full details and a quotation.
Standard items that are in stock will be delivered within 15 working days. If there is a change to this time scale we will contact you to advice. We work with a number of approved suppliers which can result in varying delivery time’s dependant on the product availability, whether it is bespoke, and seasonality.
Heavy Goods items or fragile items that are in stock, such as mirrors, are delivered via specialist couriers. If items are in stock they will take up to 15 working days to deliver. If there is a delay to this we will let you know.
Once you have been notified that your item has been dispatched, you can track its progress by call the showroom or request a tracking number. This will also enable you to track your item(s) on the relevant courier website.
Bespoke made to order Items
Our bespoke upholstery and Berggren collections are made to order especially for you and take a little time to make. The following is an approximate lead time on delivery.

Respire Sofa and Arm Chair Collection 10-12 weeks
Respire Occasional Chairs (Tub/ Small chairs) Collection: 6-8 weeks

As an dependant retailer, we do not have the courier buying power of a multiple. We only charge what it costs us, and in most cases we subsidise.
If you order multiple items consisting of a combination of both Standard and Heavy Goods items you may receive more than one delivery as they may be delivered by different couriers (please see above for the differing delivery methods/timings).
You may also receive more than one delivery as a result of one or more of your items currently being out of stock, this will have been detailed when you place your order but if you require further information please contact our Showroom on +44 (0) 1424-433000. Unfortunately we are unable to take old furniture away, but will assist you where possible.
When your piece arrives, the Courier delivery men if required will remove all packaging and place in the room of your choice. If you require assembly of your furniture, this can be booked at the time of ordering and up to the time of delivery, but will incur an additional charge.

CLICK AND COLLECT
What is Click & Collect?
Click and collect is a free delivery option that is available when you place an order online.
What products are eligible for Click & Collect?
Click & Collect is available for all non-heavy items that do not require a 2 person collection service unless agreed prior to the collection. When placing an order for this service the products must be eligible for Click & Collect, if you are ordering a mixture of delivered and Click & Collect you must make a separate order for each item.
How does Click & Collect work?
Simply add standard items to your bag and go to the checkout. If your order qualifies for Click & Collect, you’ll see this option in the delivery details section of the checkout – you just need to tick the box. Once you order is available for collection you will be notified by email. There’s no need to enter any delivery address details as that is automatically done for you.
What happens if I don’t pick up my order the next day?
We understand that you might not want to collect your order right away, so we’ll keep your order for 7 days, unless otherwise agreed. During this time, we’ll give you a call to remind you that your items are waiting to be collected.
If you know that you won’t be able to collect your order within 7 days, please give the showroom a call and we’ll be happy to make alternative arrangements.
Where do I collect my order from?
Simply request your order from a member of our friendly team in the showroom, and they will be available to assist you upon collection. Please ensure you have adequate transport when collecting your order.
Can someone else collect my order?
Yes, they just need to bring your order confirmation email with them as proof of purchase.
How do I return Click & Collect items?

When will I be able to collect my order?
The collection grids below explain when your order will be available for collection if the item is in stock. If not, we’ll give you a call to confirm when it has arrived and ready for collection.

Promotional Code terms & Conditions
Unless otherwise stated, promotional codes cannot be used in conjunction with any other offer or discounts.
Free delivery promotions exclude deliveries to anywhere outside the UK mainland.
You may use published promotional codes through our website only unless otherwise stated and not in conjunction with any other offer. You may participate in offers once only. Unless otherwise stated, Little Greene Paint, P&P, gift vouchers and sale (clearance) items are excluded from offers.
These offers are not for resale or publication and only apply to personal orders with all orders being subject to acceptance under Respire Living standard terms and conditions – orders that are considered to be commercial may be excluded from the offer.
Promotional codes are not valid against shipping rates. In the case of part-refunds, a percentage of the item’s value will be calculated and refunded as per the total order value.
Promotional codes may only be redeemed against in-stock items and cannot be retained for usage beyond their date of expiry. Where a minimum spend is stipulated, this refers to the order subtotal exclusive of shipping.
We are unable to apply discount codes retrospectively to an order once the sale has been made.
We reserve the right to cancel any promotion, offer or promotional code after seven working days of publication.
Furniture Returns Disclaimer
We always aim to offer the best possible service at Respire Living, which is why we’ve teamed with a number of furniture couriers to deliver any furniture item to a room of your choice.
Upon receipt of your order, it is your responsibility to check the goods for any faults or damages straight away. You will be required to sign a confirmation that the goods have been delivered in a satisfactory condition. This gives you the opportunity to refuse a faulty item and allows us to resolve the issue as quickly as possible. If you cannot be there to sign the confirmation, you have 72 hours to notify our customer care team of any damage or fault.
Any furniture item that is not part of our bespoke made to order collection can be cancelled and returned within 14 days of receiving the goods. You are responsible for ensuring items are returned in a perfectly saleable condition and in its original packaging. Failure to do so may result in Respire Living being unable to issue a refund. We can organise a courier to collect your unwanted items at a cost of £75.00, to organise this please contact our customer care team.
If you believe your item is faulty, please contact our customer care team straight away on +44 (0) 1424 433000 or email email@example.com we will be able to advise you on the next steps and will help to organise a return or a replacement.
Please DO NOT attempt to assemble or fix an item yourself or via a third party as this will affect your entitlement to a refund, compensation or reimbursement. We also ask that you do not return a faulty item without contacting our customer care team first.
If an item is agreed to be faulty or defective, you will not be responsible for covering the returns postage cost.
We are only able to offer a like-for-like exchanges if the item is faulty and there is available stock. If a refund is not relevant and the like-for-like item is out of stock, a credit note will be issued for the value of the item and you will have one year to redeem this credit.
Returns Policy & process
Customer satisfaction is of the utmost importance to us here at Respire Living so please contact us as soon as you think you may have a problem. . We will offer a replacement where possible within 8 weeks, or an alternative or a credit note or a refund. We regret that the cost of delivery cannot be refunded. If we cannot deliver an item within 8 weeks, we will offer a replacement product. Credit notes are valid for 6 months from the date issued. Refunds may take up to 5 days to process. Your statutory rights are not affected
How to return heavy or fragile items free of charge:
Please note: it is possible to return heavy items after you’ve accepted a delivery, but there is a charge of £75 to do this. To organise a return, please call our showroom +44 (0) 1424 433000 within 14 days of receiving your goods. We will require a completed returns form to process your request and it may take up to 28 days for collection (40 days for more remote areas).
Except where the item is faulty, you will be required to arrange and pay for the return of the products to us. We can arrange to collect the products from you, but the cost of this will be charged to you. When you are returning items to us, please obtain a receipt of postage as we cannot be responsible for items that fail to reach us.
- Please call our showroom on +44 (0) 1424 433000 within 14 days of receiving your goods.
- Our team can if requested organise for a courier to collect your order from you.
- We ask that you return products to us unused, in their original packaging with any tamper seals intact.
- Please include a completed returns form with your items which will be emailed to you.
- Please ensure that returns are packed and labelled carefully so that they are not lost or damaged in transit.
- Any returned goods must reach us within 28 days of delivery.
Return to Respire Living Showroom:
- Smaller goods can also be returned to the showroom.
- Please do check with the showroom on +44 (0) 1424-433000 before making your journey.
- We ask that you return products to us unused, in their original packaging with any tamper seals intact.
- Please include a completed Returns Form with your items.
- Any returned goods must reach us within 28 days of delivery.
Returning damaged goods:
We’re happy to replace any damaged goods you might have received – all we ask is that you follow the returns process above to ensure a quick and easy replacement. Once we have received the original damaged items at the warehouse, we will despatch your replacement goods as soon as possible.
Unfortunately, we’re not able to give refunds for the following items:
- Unwanted items returned after 28 days.
- Items without a completed returns form.
- Damaged items not notified by telephone to us within 14 days.
- All bespoke items including made-to-measure Rugs and Furniture*.
- Any orders of fabric by the metre.
- Gift Vouchers.
*With our custom made products we are sorry, but we are unable to refund unless they are damaged or faulty. If items received are damaged or faulty please notify via mail or phone within 24 Hours.
This does not affect your statutory rights.
Trade & Interior Design Returns:
If you are a Trade or Interior Design client and wish to return a large, heavy or fragile item, please contact the Trade Design Team on +44 (0) 1424-433000 within 14 days of delivery to arrange collection of your unwanted goods. Our charges for returning large items are as follows:
- Returns value under £2,500: £50.00 fee per item.
- Returns value between £5,000 – £10,000: £500.00 flat fee.
- Returns value over £15,000: £1,000 flat fee.

Retuning Bespoke made to order products
When ordering one of our bespoke made-to-order items you are agreeing to the following terms and conditions:
Once the purchase of a bespoke made-to-order item has been made, the order cannot be cancelled. If for whatever reason, you change your mind about an item, a 25% cancelation fee will be applied.
Should you choose to return the furniture to us for any reason within 14 days of delivery, Respire Living reserves the right to retain 20% of the items cost as it was not a stock item and was made specifically for you.
To arrange a return for your bespoke order, you must contact our customer care team on 01424 433000 or firstname.lastname@example.org within 14 working days from delivery. A return collection will then be made at a cost to you.
You must ensure items are returned to us in a perfectly saleable condition and in original packaging. Failure to do so will result in Respire Living being unable to refund you.
Any bespoke made-to-order items upholstered in a customer’s own fabric or material cannot be cancelled, returned or refunded once purchased.
Please ensure you measure your space correctly before placing your order. Be sure to consider staircases, doorways and any tight spaces as your furniture may need to be manoeuvred through these spaces. If you need to return an item of furniture, the original delivery charge plus a collection charge will be deducted from any refund or exchange value.
Returning Self assembly products
If an item requires self-assembly or installing, please check all components thoroughly for any damage or missing parts BEFORE attempting assembly or installation. If any damage is spotted or items are missing, please contact our customer care team on +44 (0) 1424-433000 or email@example.com
Self-assembly and installation products must be returned unused and in their original packaging and cannot be returned once partially or fully assembled, or once modifications have been made to install unless it is agreed the item is faulty.
Each sofa collection is covered by a manufacturer’s guarantee of various lengths and inclusiveness. Please refer to the item product page or ask a member of staff prior to purchase so that you can be provided with correct and complete information.
Fabric Covered items
Whilst every effort has been made to ensure that colour reproduction is as accurate as possible, slight variations may occur as a result of the photographic process or batch of fabric. We recommend that you order a fabric swatch prior to ordering to check that the colour and design is suitable.
All sofas should be cleaned using a Professional Upholstery Dry Cleaner, for Modena Velvet or fabrics that have an anti-stain repellent, where liquid (drinks) are spilt on it DO NOT try to dilute it, act quickly using absorbent kitchen towels or cloths, dab over it to soak up the liquid. Once the liquid is removed use a nonabrasive cleaner such as a baby wet-wipe. If the spillage is on the seat cover, remove the seat cover to protect the cushion
Please note that upholstery and wooden furniture is likely to fade if left in direct sunlight for prolonged periods. Double or triple glazed windows are able to slow the rate of damage caused by UV light, but we suggest keeping susceptible items away from direct sunlight.
Respire Living provide a 1 year guarantee for all our lighting products.
During this guarantee period, the Company will replace the product or its defective parts subject to the terms and conditions.
1) Guarantee services will be provided only if the original invoice or sales is presented with the defective product within the guarantee period. The Company may refuse guarantee service if these documents are not available.
2) This Guarantee does not cover transport costs and risks associated with transport of the product to and from The Company instructions.
3) This guarantee does not cover:
- a) periodic maintenance, the repair or replacement of parts due to wear and tear
- b) consumables (components that are expected to require periodic replacement during the lifetime of a lamp such as batteries, starters, bulbs, ballasts, etc.)
- c) damage or defects caused by use or treatment of the product inconsistent with normal use
- d) damage or changes to the product as a result of:
- misuse, including: – treatment resulting in physical, cosmetic or surface damage or changes to the product failure to install or use the product for its normal purpose or in accordance with The Company.
- installation or use of the product in a manner inconsistent with the technical or safety laws or standards in the country where it is installed or used
- use of the product with accessories, peripheral equipment and other products of a type, condition and standard other than recommended by the Company
- repair or attempted repair by persons who are not authorized by The Company and adjustments, adaptations without the Company prior written consent
- accidents, fire, liquids, chemicals, other substances, flooding, vibrations, excessive heat, improper ventilation, power surges, excess or incorrect supply or input voltage, radiation, electrostatic discharges including lighting, other external forces and impacts.
All Respire Living products are supplied with a 12 month warranty for any defect that may occur with the product at this time. Any defective product can be returned to us for inspection and repair where possible. Any credit or refund against the defective product will be given at our discretion and dependent on the nature of the defect. All product warranties are subject to correct use of the product and will be invalidated by misuse, for example incorrect installation or unsuitable environmental conditions.

Third party & remarketing cookies are connected with services such as social media networks that provide like, share & pin buttons. We partner with carefully selected suppliers who may also store cookies on your computer to present remarketing banners to you based on recently viewed products or products that may be of interest to you.

How a Respire Living Trade Account Works
The following information is required (to be completed on your application form):
- Your VAT registration number
- Your full name, company name, company address and type of business
- Director’s name and contact details
- Website and telephone numbers
- A minimum of two Trade references
- A printed or scanned copy of your company letterhead and business card
The discounts we provide:
- 15% initial discount
- 25% discount for accounts that value or exceed £6,000 per annum, the 10%n difference will be paid retrospectively at the end of your year.
Terms of your discount:
- An initial spend of £250 on your account is required to activate Trade Discount.
- £2500 total spend per annum is required to keep your account active.
- All Trade Accounts are reviewed on an annual basis to evaluate yearly spending and discount eligibility.
- We can deliver your goods to anywhere in the UK or Europe, unfortunately, we cannot deliver outside Europe.
- Delivery charges are as per our Delivery schedule in the T&C’s section
- Collection can also be arranged from our warehouse St Leonards on Sea; however, 48 hours’ notice is required.
Businesses that qualify for Trade Accounts: We consider applications from all businesses, Interior Designers, Hotels, Bar & Restaurants, if you are unsure, please call or send your application for us to review.
You can view our collection of furniture and accessories online at respireliving.com. Our in our showroom is in Old Town Hastings, although the showroom does not carry the full range available.
We do take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. However, as many of our products are not mass-produced, and many are either hand-made from natural materials or hand-finished, slight variations in colour and/ or size may occur.
Although we aim to keep the Website as up to date as possible, the information, including Product Descriptions, appearing on this Website at a particular time may not always reflect the situation at the exact moment you place an order. The images shown online are for illustration purposes only. Many products are also shown with additional props but these are not included in the sale of a product unless otherwise specified.
